During the registration process, you will be asked to provide us with certain Information like your username, email address, password etc. that are required to operate these features and services. As this is not technically Personal Information we feel it a responsibility to identify the information we collect for you to have an understand of what it is and how it is used.

Display Name - To identify yourself on the website to other users with a customizable name.

Email Address - This is used as a secondary identification for your account and is also used to contact you or send notifications that you request with a subscription.

Layout Name - A name used to identify your layout.
Industries - Names of your industries used in the operation of waybills.
Custom Commodities - Names of your own commodities used in the operation of waybills.
Cars - Information relating to the identification of specific cars on your layout.
Waybills - Information relating to the opertaions and movements of cars and commodities over your layout.

(iii) Shareable Information
Shareable Information is any piece of information that is attached to your account that or the site collects as part of the Shareable Information. In order for the website to function and for your own personalisation of your Shareable Information this data is collected.
By voluntarily providing this Shareable Information to us, you will be consenting to the collection, use and distribution of your Shareable Information by us, for the purposes specified in the Privacy Policy. Please note that you are under no obligation to provide us with any Shareable Information and can access and enjoy many parts of the Website without providing us with any Shareable Information.

(iv) Settings

Please note that you are under no obligation to provide us with any Support Tickets and can access and enjoy many parts of the Website without creating one.

(vi) Anonymous Information About Visits in the Website
When you visit the Website (whether as a member or as a visitor), information about your visit (such as how you navigate the site) may be collected and stored. This information may include your Internet Protocol (IP) address, browser and platform type, the length of your visit, the date and time of your visit, the pages you viewed and the order of those pages, the amount of time spent on particular pages, and the websites you visit before and after leaving the Website. 2. What does TrainWaybills.com do with this information?

(i) Personal Information
Username - This may publicly shared on the website to identify you on the site and used for login purposes.
Display Name - This is shared on the website to identify you on the site to other users.
Password - This is never shared, cannot be seen by any member of staff and is Encrypted without the ability to be decrypted or recovered.
Email Address - This is used as a secondary identification for your account and is also used to contact you for a variety of reasons (explained later in this Privacy Policy) but is not shared with any other users on the site. Moderation staff also cannot see your full email address however Admin staff are able to access this data for administration purposes. It may also be used to identify other accounts you may own by our systems and if requested by you or the Forgot Username automated system. This may also be used for security purposes but not shared with any third party with the exception of a request by legal authority with a valid reason or subpoena, a dispute process, or when communicating to you via email, which are explained later in this Privacy Policy.

(ii) Session Information
All Session information is shared by users conected to your operating session. This is only information for the purpose of operating waybills on your layout.

(iii) Shareable Information
Shareable Information has the ability to be shown to the site. At the time of publish, we have no such inforamtion with the exception of Session Information.

(iv) Settings
Settings are stored to save your customisation setting of your account.

(v) Support Tickets
Support Tickets are saved for the purposes of supporting your requests and also retained for training or reference purposes. This information is not shared publicly, used only by staff and the account holder, but not shared with any third party with the exception of a request by legal authority with a valid reason or subpoena, or a dispute process which is explained later in this Privacy Policy.

(vi) Anonymous Information About Visits in the Website
This data is used for analytical reasons to improve the site, monitor traffic, moderation and for security purposes. Some of this data is acquired by 3rd parties such as google for Analytics and Adsense whose Privacy Policy and settings can be viewed from the links below.

3. What information is gathered during a payment and how is it used?

Please note that transactions on the site are also covered by our Refund Policy.

(i) Invoice Information
When an invoice is generated the only information collected is your User ID, The time of generation and sale completion, the transaction ID for reference and the account type. These are stored securely on our servers for reference, financial process purposes or at the request by legal authority with a valid reason or subpoena, or for use in a dispute process.

(ii) Transactions
We do not process transactions directly on our site and have no access to credit card details or customer private transaction details. We use Paypal as our merchant service and only receive the information required for that process. Paypals Privacy Policy can be found below.

4. How else is my Email address used?

(i) Marketing
We use your Email address to Email users of the site using our own Email servers with regards to promotions on the site, this can be turned on and off from your Account Settings. This system is internal and we do not use any third party for this use.

(ii) Subscriptions
We have a subscription service which will alert you by Email of a session started by someone you have opted to subscribe to. You can turn off Email alerts for each individual subscription from your Account Settings. This system is internal and we do not use any third party for this use.

(iii) notifications
We may need to contact you regarding changes to our systems or important notices regarding this site, this cannot be turned off as it may contain critical information regarding your account or the site. These messages are rare and only used if necessary. This system is internal and we do not use any third party for this use.

(iv) Responding
If you email us and require a reply, we use a third party provider to administer and store our email. We will never ask for passwords or stream keys and prefer you to use our own Ticket System to ensure your data is safe. Our providers Privacy Policy can be found below.

5. Storage of our data

(i) Protection of data
We maintain technical, physical, and administrative security measures designed to provide reasonable protection for your Personal Data against loss, misuse, unauthorised access, disclosure, and alteration.  The security measures include firewalls, data encryption, and information access authorisation controls.  While we are dedicated to securing our systems and Services, you are responsible for securing and maintaining the privacy of your password(s) and Account/profile registration information and verifying that the Personal Data we maintain about you is accurate and current.  We are not responsible for protecting any Personal Data that we share with a third-party based on any process you have invoked such as, an illegal activity requiring us to legally release your data or a dispute process requiring information to be released.

If we learn of a breach of the security, then we shall take any legally required disclosures and notification of such breach, via email, news feed or by posting a notice on the Website, in the most expedient time possible and without unreasonable delay.

You should be aware that your information may be transferred to and/or maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.

(ii) Data retention
We retain Data which may include Personal Data in an identifiable format for the least amount of time necessary to fulfill our legal or regulatory obligations and for our business purposes.  We may retain data which may include Personal Data for longer periods than required by law if it is in our legitimate business interests or security and not prohibited by law.  If your Account is closed, we may take steps to mask Personal Data and other information, but we reserve our ability to retain and access the data for so long as required to comply with applicable laws. We will continue to use and disclose such data which may include Personal Data in accordance with this Privacy Policy.

 

6. What chat data is used and stored?

For the operation of the site and for administrative purposes chat data is saved for a maximum of 3 days before being destroyed. This data may also be archived if it is deemed necessary and in accordance with Section 4(ii). Chat data is currently only available to users of the site in the chat room at the time and Historical Data to Moderators for Moderation purposes with the exception of Personal Messaging Data which is available to the users involved in the communication and not Moderators. Moderators are not able to view Personal Messaging data which cannot be used in disputes unless the moderator themselves instigated the Personal Message or you send us a transcript of the message yourself.

 

7. What can I do regarding my personal information?

It's our job to keep your personal information safe and secure. That's why we design our services with your safety and the safety of our users in mind. And we're always looking for the best ways to improve this.

(i) Deleting my Personal Information
You can delete your account at any time and we will be sorry to see you leave. Your account is deleted and you will no longer have access to the website using the deleted account. Keep in mind, we keep a record of your account for a short amount to time up to 1 week to ensure that we can recover your account if necessary for your benefit. If you wish to recover your account after this time it will not be possible as much of the data will be permanently deleted. With the account deleted we will no longer be collecting data for the account. We may retain some information necessary to fulfill the continued running of the site (for instance Social Feed post data and likes data) or for the purpose of security see section 4(ii). We also require to keep a record of the deleted account to ensure the account is not recreated by another user for security reasons and your safety as an individual. Non public data that we retain outlined above is not shared publicly, used only by staff for moderation or security purposes and not shared with any third party with the exception of a request by legal authority with a valid reason or subpoena, or a dispute process.

(ii) Am I able to get a copy of my Personal Information?
This is called the right of access. This right allows you to ask for full details of the personal information we hold on you. As we do not technically collect any Personal Information about you it is not stored anywhere on your profile. Please note this stored information is accessible to you on your account and account settings however if you feel it necessary you can contact us using the Contact Us page and creating a ticket or email us at [email protected]
Bear in mind, when we get back to you, we might need some identification to check that you are who you say you are. There might be some occasions where we can't fulfill a request. For example, If it might impact on the rights of another person or company, If you haven't given us all the information we need, including proof of ID, The law tells us we can't, and sometimes if we feel your request is excessive. If we can't help you, we'll get back to you and explain the reasons why. We'll aim to get back to you within one month. For more complicated requests, or for a large amount of requests, we might take longer, but we'll tell you if there's a delay and the reasons why.

(iii) Can I change Information or how we use your Personal Information?

However, others, like your username cannot be changed due to the way the website functions with the exception of changing capital letters and not the spelling.
